These General Conditions of Sale and Use (referred to as “CGV”) are concluded between:
On the one hand, “the seller” designates the company SERAFINA HOME , with the status of a simplified joint stock company registered in the trade and companies register of Chalon-sur-Saône, under the following Siret number: 948 475 413 00019, of which the head office is located at 85b Promenade Paul Auguste-Rey, 71210 Torcy. On the other hand, “the user”, “the buyer” or “the customer” refers to any natural or legal person wishing to make a purchase of clothing or fashion accessories on the company's website, available via the URL following: serafinahome.fr
ARTICLE 1 - PURPOSE AND FIELDS OF APPLICATION
These conditions of sale aim to define the contractual relations between the company SERAFINA HOME and the customer, on the conditions applicable to any purchase made solely through the website of the company with the following URL: serafinahome.fr in mainland France and in Corsica (excluding Dom Tom).
The acquisition of a product through this site implies unreserved acceptance by the buyer of these conditions of sale, of which the buyer acknowledges having read prior to his order.
The company SERAFINA HOME reserves the right to modify or adapt these general conditions of sale, which will apply to all orders according to the General Terms and Conditions in force on the day of the order.
The customer declares to purchase products for strictly personal use and in no case for commercial purposes, in particular with a view to resale. The latter must be of legal age and have full legal capacity, allowing him to commit to these general conditions of sale.
ARTICLE 2 - PRODUCTS AND AVAILABILITY
The SERAFINA HOME company's offering essentially consists of household linen items, ready to wear for women. The complete offer appears in the site catalog, with a price indicated including tax in euros. Each product available for sale has a detailed description of its technical characteristics, and accompanied by photos established by the company SERAFINA HOME . The photographs and information are non-contractual. However, in the event of a defect or non-conformity of the product, the company undertakes to find a satisfactory solution for the buyer, the seller being subject to the legal guarantee of conformity provided for in articles L.217-4 et seq. of the Code of consumption as well as the legal guarantee against hidden defects provided for in articles 1641 et seq. of the Civil Code. Unless otherwise indicated on the site, all products sold by the seller are new and comply with current European legislation and the standards applicable in France.
The availability of products is valid as long as they are visible on the site and while stocks last. An update of the stock status is carried out after each order to ensure the availability of the items on sale, but the company SERAFINA HOME cannot be held responsible in the event of a stock shortage. In the event of unavailability of the ordered product, the company SERAFINA HOME undertakes to inform the customer by email to obtain a refund or a credit corresponding to the price of the product purchased, within a maximum period of 7 days from the validation date of the order.
ARTICLE 3 - PRICES AND OFFERS
The prices displayed on the site are indicated in euros (including tax). Prices include value added tax (VAT) at the rate in effect on the order date, expressed as a percentage of the value of the product sold. The change in the applicable rate may impact the price of the products from the date the new rate comes into force.
The prices indicated are valid, unless there is a gross error (display of an incorrect price that is obviously derisory, whatever the reason: computer bug, manual error, technical error). The company reserves the right to cancel the order for the item in question and refund the buyer the amount paid.
SERAFINA HOME reserves the right to modify its prices at any time, but the applicable price is that indicated on the site on the date on which the order is placed by the customer.
The prices of the products mentioned on the website do not take into account delivery costs, invoiced in addition, and indicated before final validation of the order.
Occasional promotional offers may be offered by the company SERAFINA HOME, they may be of a strictly personal nature and be applicable for a limited period. Under no circumstances will the buyer be able to demand the application of reduction which is no longer in force on the day of the order or which has not been communicated to him. Promotional offers can be in the form of a direct discount or a promotional code to be added at checkout. The buyer can use a maximum of one promotional code per order. If you forget to add a promotional code, the buyer will not be able to obtain a refund of the amount thereof under any circumstances.
ARTICLE 4 - ORDER
Products are ordered on the serafinahome.fr website and are only available in mainland France and Corsica (excluding overseas territories). It implies full and unreserved acceptance of these General Terms and Conditions by checking the box provided for this purpose.
Before placing any order, the buyer may or may not create a customer account on the serafinahome.fr site and must complete a form, containing in particular the following information: Name, first name, full delivery and billing address, e-mail, phone number and password. This information is important so that the order can be recorded and shipped.
The buyer undertakes to verify the following information before validating his order: the quantity, the references ordered, the means of delivery, the price and his personal information. In the event of an error, SAS SERAFINA HOME will not be held responsible for entry errors and the consequences that could result from them, such as a delay or delivery error. In such a case, all costs incurred for reshipping the order will be entirely the responsibility of the customer.
Validation of the order is carried out by sending a confirmation message to the email address that the latter will have communicated. The sale will only be concluded upon sending of said order confirmation. The customer will be able to print their invoice by logging into their customer account. SAS SERAFINA HOME reserves the right to refuse or cancel any order from a customer, particularly in the event of insolvency of said customer or in the event of failure to pay for the order concerned or a dispute relating to to a previous order in accordance with article L.122-1 of the Consumer Code.
ARTICLE 5 - PAYMENT
Full payment must be made in cash when ordering and according to the payment methods offered by the serafinahome.fr site.
The buyer will be able to choose between three fast and secure payment types:
- Via credit card : the buyer will be required to give the number of their bank card and, depending on the type of card, its expiry date as well as the cryptogram made up of the last three digits appearing on the back of it on the secure PAYPLUG platform. The transaction will be immediately debited upon receipt of debit authorization from the company issuing the bank card used by the customer.
- Via Paypal : If the buyer has a customer account. The transaction will be immediately debited from the Paypal account according to the payment conditions that the customer has defined. PayPal encrypts all of its customer's information.
The order will only be considered effective when the secure banking payment center has given its agreement to the transaction and, where applicable, after acceptance of the assumption of the risk by the insurer. If the customer's payment is refused or if the company suspects fraud, the sale of the products will then be terminated and the order canceled.
ARTICLE 6 - DELIVERY
As previously indicated in article 1, delivery is only available in mainland France (excluding Dom Tom). The delivery time will depend (excluding weekends and public holidays) on the carrier chosen. (Find out more in the delivery section)
For any order placed on the serafinahome.fr site, the buyer must pay a flat rate contribution to the delivery costs, except in the case of free delivery resulting from a promotional offer. The buyer must choose their delivery method from the following carriers:
- Mondial relay : €4.50 for delivery to a relay point
- La Poste Colissimo : €4.95 for home delivery without signature
- Shop2shop by Chronopost : €6.80 for delivery to a relay point
- Chrono Relais 13 (fast delivery in 24 hours) by Chronopost : €10.80 for delivery to a relay point.
The gift cards are dematerialized, they are sent automatically by email after validation of payment and not by post.
After confirmation of the order, SERAFINA HOME undertakes to process and ship the products ordered to the delivery address indicated by the customer, within 1 to 3 working days (excluding weekends and public holidays) . This period may be extended during busy periods such as sales, Black Friday, private sales, etc.
As soon as the order is shipped by SERAFINA HOME , an email will be automatically sent to the customer, including the package tracking link. If the maximum deadline announced is exceeded, the customer has the option of canceling his order and obtaining a full refund.
Once the package has been handed over to the carrier, the average delivery time is 2 to 5 days depending on the carrier chosen . Please note that SERAFINA HOME cannot be held responsible for possible delivery delays or errors attributed to carriers. In the event of a reception problem, the buyer is required to contact the carrier before making any complaint to SERAFINA HOME customer service, reachable at the following email address: serafinahome@outlook.fr
In the event of impossibility of delivery following an error in the information provided by the customer when placing the order, the company cannot be held responsible for the non-delivery of the package. In this context, all costs incurred for reshipping the order will be entirely the responsibility of the customer.
ARTICLE 7 - RIGHT OF WITHDRAWAL AND REFUND
In accordance with the provisions of articles L.221-18 et seq. of the Consumer Code, the customer has a period of 14 days from the date of receipt or collection of your order to return the products ordered, without having to justify yourself or pay penalties, except for return costs.
The product(s) subject to withdrawal must be returned in their original packaging and must not be worn, washed or stained and must still have its label. If the returned items do not meet these conditions, the company SERAFINA HOME will be able to refuse reimbursement.
To exercise his right of withdrawal, the customer must quickly inform the seller of his decision by completing the returns form available in the “ Returns & Refunds ” tab. The customer must then return the product(s) concerned using the return slip sent by email by SERAFINA HOME customer service.
Please note: Items resulting from a purchase via gift card or credit cannot be reimbursed but only as a credit.
Upon receipt and verification of the return package, the reimbursement will be made in the form of a credit note or a bank reimbursement within a maximum of 14 days from the date of receipt of the package by the seller. Since return costs are charged to the buyer (except in the context of a credit note), the fixed amount of 4.00 euros (via Mondial Relay) or 8.00 via Colissimo will be deducted from the reimbursement for the prepaid label. Credits, vouchers or gift vouchers cannot be subject to bank reimbursement.
ARTICLE 8 - GUARANTEE
The seller is subject to the legal guarantee of conformity provided for in articles L.217-4 et seq. of the Consumer Code.
In the event of non-conformity of the product received or damage to it, the customer is required to promptly inform the company SERAFINA HOME , which undertakes to reimburse the customer or exchange the products in question, if stock allows. within a maximum period of 14 days. Shipping and return costs will be covered by the seller.
The seller is also subject to the legal guarantee against hidden defects provided for in articles 1641 et seq. of the Civil Code.
In the event of non-compliance with the guarantee against hidden defects, the customer may request a refund of the price of the product after returning it in its original condition, or a refund of part of the price if he wishes to keep the product. SERAFINA HOME undertakes to make the refund or semi-refund within a maximum period of 14 days.
ARTICLE 9 - INTELLECTUAL PROPERTY
All elements of the serafinahome.fr site such as the communication visuals are and remain the intellectual and exclusive property of the company SERAFINA HOME . As such and in accordance with the intellectual property code, any total or partial reproduction, modification or use is strictly prohibited. However, the use of simple or hypertext links to the site is authorized without specific request.
Violation of the provisions of article L122-4 of the Intellectual Property Code constitutes an infringement within the meaning of article L335-2 of the same code, which constitutes an offense.

These general conditions of sale are written in French and governed by French law. In the event of a dispute, the customer will first contact SERAFINA HOME to obtain an amicable solution. Otherwise, and in accordance with the provisions of articles 46 to 48 of the Code of Civil Procedure, the French courts will have sole jurisdiction.
